Anxiety Damage Recognized as Personal Injury by the French Supreme Court
In a landmark decision dated 29 May 2026 (No. 24-17.384), the French Court of Cassation held that anxiety damage resulting from exposure to a toxic substance constitutes damage arising from personal injury.
The key issue was whether victims exposed to hazardous substances and fearing the onset of a serious illness were subject to the ordinary five-year limitation period or to the ten-year limitation period applicable to personal injury claims.
The Court ruled that anxiety caused by exposure to toxic substances affects a person's psychological integrity and therefore falls within the scope of personal injury. As a result, claims for compensation benefit from the ten-year limitation period applicable to bodily injury cases.
This decision significantly strengthens the rights of victims exposed to hazardous substances, such as asbestos, DES (Distilbene), or other toxic products, by granting them a longer period to seek compensation and by confirming the bodily nature of anxiety-related harm.
